Abstract
This study aims to: 1. To find out and understand the implementation of land transfer rights due to grants in Abeli District 2. To find out and understand the factors that hinder the registration of land transfer rights due to grants. This study was conducted at the Abeli District Office, Kendari City. The implementation uses primary and secondary data used in this study is qualitative analysis, namely examining and reviewing legal material data and all types of information and data obtained and then described in the form of logical and systematic descriptions to answer the problems in this study so that conclusions and solutions to the problems can be obtained. The results of the study indicate that the transfer of land ownership rights through grants in Abeli District has not been fully implemented in accordance with the provisions of applicable laws and regulations and based on the results of the study it was obtained that the transfer of land ownership rights through grants was carried out through 2 stages, namely first, making a deed of grant at the Land Deed Making Officer. Then the second stage of registration at the Kendari City National Land Agency in accordance with Article 37 paragraph (1) and Article 39 of Government Regulation Number 24 of 1997, explains that every grant of land must be made with a PPAT deed. The implementation of land administration and land registration recorded at the Land Office must always be in accordance with the actual conditions or status. The conditions and status of the land area in question, both concerning physical data regarding the land area, as well as regarding legal relations concerning the land area, or this legal data, especially recording changes to previously recorded legal data.2. Obstacles to the implementation of registration of transfer of land ownership rights due to grants that occur, namely: 1. Economic factors that work as farm laborers 2. Socio-Cultural Factors 3. Lack of Socialization to the Community Lack of socialization to the community about the importance of land registration to ensure legal certainty regarding land ownership.
