TINJAUAN YURIDIS TERHADAP TINDAK PIDANA ILLEGAL FISHING (Suatu Studi Di Polsek Kulisusu Kab. Buton Utara)
Abstract
This research was conducted at the Kulisusu Police Station, North Buton Regency from May to July 2017. The data obtained in this study were analyzed qualitatively. This study aims to determine the factors that cause illegal fishing in the Kulisusu Police Station, North Buton Regency and the efforts that must be made to overcome illegal fishing in the Kulisusu Police Station, North Buton Regency and the obstacles experienced by members of the Kulisusu Police Station in overcoming illegal fishing. The results of the study indicate that: The factors that influence the occurrence of illegal fishing in the jurisdiction of the Kulisusu Police Station, North Buton are the low economic factor of the fishing community, the minimal knowledge factor of the dangers and impacts of illegal fishing, and the low education factor so that they tend to think instantly without considering the consequences of illegal fishing; and Efforts to overcome illegal fishing carried out by investigators in the jurisdiction of the Kulisusu Police Station, North Buton include: a. Preventive efforts: 1) Conducting legal counseling, 2) Conducting routine patrols, 3) Cooperating with other related agencies. b. Repressive efforts: in the form of making arrests and examinations and enforcing the law firmly in applying sanctions to perpetrators of illegal fishing. and the obstacles found by the Water Police investigators in handling illegal fishing crimes are the lack of coordination between investigators who are authorized to handle destructive fishing crimes, the lack of understanding of suspects in destructive fishing cases in undergoing the examination process, the lack of budget in handling illegal fishing cases, and the lack of facilities and infrastructure in carrying out investigations, criminal investigations in the waters of the Kulisusu Buton Utara Police.
