TINJAUAN YURIDIS TERJADINYA TINDAK PIDANA PEMBUNUHAN BERENCANA (Suatu Studi di Kota Kendari)

Abstract

This study aims to determine the factors that cause the application of criminal law to the crime of premeditated murder and to determine what efforts are made to overcome premeditated murder in Kendari City. This study was conducted in Kendari City by focusing research on agencies related to the problems in the thesis. By studying the data obtained from the results of interviews and from literature studies, books, documents, and laws and regulations related to the problems discussed. Based on the results of the analysis of existing facts and data, the author draws conclusions including: The factors causing the occurrence of premeditated murder in Kendari City are caused by several factors, namely economic factors, legal awareness factors and environmental factors, where the factors in question have a relationship that influences each other; and The efforts made in order to prevent and overcome the occurrence of premeditated murder in Kendari City, namely through preventive and repressive actions. In connection with the increasing number of cases of premeditated murder that occurred in Kendari City, it is hoped that competent parties, especially law enforcement officers, can create new patterns in carrying out efforts to prevent and overcome crimes, especially violent crimes, or at least restore and/or prioritize patterns of crime prevention and overcoming that uphold the values ​​of togetherness rather than patterns of prevention and overcoming that prioritize individual values ​​and law enforcement officers carry out socialization in order to increase legal knowledge and understanding of the Kendari City community.
