TINJAUAN YURIDIS PERAN JUSTICE COLLABORATOR (PELAKU BEKERJASAMA ) DALAM MENGUNGKAP TINDAK PIDANA KORUPSI (Suatu Studi Di Pengadilan Tipikor Kendari)
Abstract
This study aims to determine the role of Justice Collaborators (Collaborating Perpetrators) in exposing Corruption Crimes and legal protection for Justice Collaborators (Collaborating Perpetrators). The study was conducted in Kendari City, precisely at the Kendari Corruption Court. This study uses descriptive research because the data obtained in the field is presented descriptively using the empirical normative approach method. Based on the analysis of the data and facts that the author has obtained, the author concludes, among others: a Justice collaborator is a powerful means of proof to reveal and expose corruption. Justice collaborators can be used as a tool of evidence in revealing new dimension crimes, such as corruption which is detrimental to the country's economy. The role of Justice collaborators was born from the condition of the country which departed from the difficulties of investigators and public prosecutors in revealing, investigating, and punishing perpetrators of organized crime that are very detrimental to the public interest. Organized criminals are so difficult to reach legally because of the neatness and sophistication of a crime that it almost “leaves no trace of evidence”. b) Legal protection for justice collaborators related to the institutional role of Witness and Victim Protection is very vital and is an effective means that can provide solutions to the stalled procedural efforts and substantial/material weaknesses of the criminal law system in uncovering various dimensional crimes with all their motives. The aspect of legal protection for justice collaborators is very important, because the legal protection contained in Law No. 13 of 2006, Joint Decree and also SEMA No. 4 of 2011 still does not provide enough protection for justice collaborators.
