Abstract

This study aims to determine the legal efforts of the Medan Police against parties who provoke and incite the demonstration and the obstacles to enforcing criminal law against parties who provoke and incite the demonstration. This research method uses an empirical legal research type with secondary data obtained through library research and field studies (interviews). Then, the data is processed using qualitative analysis. Based on the results of the study, it is known that the legal efforts of the Kendari Police against parties who provoke and incite the demonstration will take security measures, which if there are actions that violate the law or lead to anarchic actions, will certainly provoke resistance from other parties, which ultimately causes many material and immaterial losses for the parties and has a negative impact on the stability of the country. So that the police continue to take serious action against parties who provoke and incite the demonstration which seems to have exceeded the reasonable limits determined by applicable laws or in other words often leads to anarchic actions. Obstacles in criminal law enforcement against parties who provoke and incite demonstrations, where it is hampered because the demonstrators do not inform the police that they will be demonstrating, lack of coordination between demonstrators and officers in the field, the presence of provocateurs who infiltrate the masses, riots in planned demonstrations, the absence of representatives willing to respond to the demonstrators, the attitude of officers who do not heed the orders of the Leader/Controller of security in the field, lack of personnel and supporting equipment in implementing security for demonstrations.
