TINJAUAN YURIDIS PROSES PENANGANAN TINDAK PIDANA PENIPUAN (Studi di Polsek Baito Polres Konawe Selatan)

Abstract

The purpose of the study was: 1). To find out the factors causing the occurrence of criminal acts of fraud. 2). To find out efforts to prevent the occurrence of criminal acts of fraud. This study was conducted in the jurisdiction of the South Konawe Police, using the type of research, namely empirical normative. The data collection method used was document study, field surveys and interviews using qualitative descriptive analysis. Based on the results of the study, it can be seen: 1). The factors causing the occurrence of criminal acts of fraud, namely a criminal act of fraud occurred, the victim (Eben) was in front of his house, suddenly the reported party (Sunardin alias Nadin Bin Tamrin) came using a white Avanza car and was invited to talk so that the victim (Eben) invited the reported party (Sunardin alias Nadin Bin Tamrin) to chat in the house, then the reported party offered the victim that "this is a house renovation assistance but because your house is already good, so I offer assistance in the form of 48 (forty-eight) sacks of Pondska fertilizer, urea, and TSP, but you have to hand over transportation and labor money of Rp. 1,200,000 (one million two hundred thousand rupiah) for 48 (forty-eight) sacks of fertilizer” because he was interested so the victim handed over to the reported party Rp. 2,500,000 (two million five hundred thousand rupiah) for 98 (ninety-eight) sacks of fertilizer. 2. Efforts to prevent the occurrence of criminal acts of fraud, namely: a. Settlement of disputes by means of litigation. This litigation method is intended that the disputes of the parties are resolved through the court process. b. non-litigation methods, namely in the form of: 1. Through negotiation. 2. Through the mediation of a mediator. c. Carried out by the South Konawe Police through the Chief of Police Sector Baito together with his staff and the local government, namely there are 2 (two) methods, namely: 1. Through Law Number 2 of 2002 concerning the Republic of Indonesia National Police through Article 2 which reads: The function of the Police is one of the functions of the State government in the field of maintaining public security and order, law enforcement, protection, protection, and service to the community. 2. Through Regulation of the Chief of Police Number 6 of 2019 concerning the investigation of criminal acts.
