TINJAUAN YURIDIS TERHADAP TINDAK PIDANA KEKERASAN YANG DILAKUKAN SECARA BERSAMA-SAMA (Studi Putusan Pn. Andoolo No. 82/Pid.B/2020/Pn.Adl)
Abstract
The objectives of the study were: 1). To find out and understand. The factors causing violence against people causing injuries. 2). To find out and understand efforts to overcome violence against people causing injuries. This study was conducted in the jurisdiction of the Andoolo District Court, using the type of research, namely empirical normative. The data collection methods used were document studies, field surveys and interviews using qualitative descriptive analysis. Based on the results of the study, it can be seen: 1). The factors causing violence against people who caused injuries, namely the defendants were drinking alcohol with friends at the lulo event venue, a moment later the music at the lulo event venue was stopped because it was late at night, seeing the music had been stopped then the defendants together with the man Erfin shouted saying "oh continue the event DJ", hearing the words of the defendants then the victim approached the defendants and the man Erfin and said "you people go home, the event is over, the event has stopped" then the man Erfin answered "why", then the victim said "enough", you people are my brothers, don't you people make a fuss here, you people go home", then the man Erfin seemed to not accept what the victim said and said "oe...oe...why...why". 2). Efforts to overcome the occurrence of violence against people who cause injuries, namely a. Preventive efforts, namely by providing legal guidance and counseling, especially criminal law regulations that threaten severe penalties for those who commit crimes, especially violent crimes committed together. b. Repressive efforts, namely must be carried out firmly in accordance with the Criminal Code and the provisions other legislation, because giving criminals the opportunity to commit despicable crimes will greatly disturb the public in general. c. Preventive efforts in the form of the Andoolo District Court Decision with Decision Number 82/Pid.B/2020/PN.Adl.
