Abstract

The objectives of the study were: 1). To determine the inhibiting and supporting factors in the implementation of prisoners' rights in Correctional Institutions 2). To determine the efforts so that the supporting and inhibiting factors in the implementation of prisoners' rights run in accordance with applicable laws and regulations. This research was conducted in Nusakambangan, precisely in the Super Maximum Security Class I Batu Nusakambangan Correctional Institution, using the type of research, namely empirical normative. The data collection methods used were document studies, field surveys and interviews using qualitative descriptive analysis. Based on the results of the study, it can be seen: 1. Inhibiting and supporting factors in the implementation of prisoners' rights in Class I Batu Nusakambangan Correctional Institution, namely a. From the prisoners themselves, because in the process of implementing prisoners' rights, they often clash with the prisoners' willingness to not accept their rights because they clash with the prisoners' different absorption capacity in receiving the education and teaching process. b. Facilities for shelter and correctional facilities for inmates are very limited, talking about funds is indeed quite risky, but in terms of technical implementation and is a very determining factor in an activity, especially concerning the protection and correctional facilities for inmates which include the implementation of the rights of inmates, especially in the mental, social, and skills fields. c. Lack of quantity and quality of Correctional Institution officers as human components that handle problems of granting inmates' rights, insufficient doctors, or medical personnel, criminologists, psychologists, psychiatrists, social workers in a correctional institution. 2. Efforts to ensure that supporting and inhibiting factors for the implementation of inmates' rights run in accordance with applicable laws and regulations, namely a. Facilities and infrastructure must be balanced with the capacity of inmates in Correctional Institutions and also the education and skills received by inmates must be in accordance with developments in society. b. Must be able to reduce the psychological impact of imprisonment, in addition to the role of the government in perfecting correctional laws.
