PELAKSANAAN PENGAWASAN DAN PENGAMATAN TERHADAP NARAPIDANA OLEH HAKIM PENGAWAS (Suatu Studi di Lembaga Pemasyarakatan (LAPAS) Klas II A Kendari)
Abstract
This study aims to determine the implementation of supervision and observation of prisoners by the Supervising Judge (Study at Class II A Kendari Penitentiary) and the obstacles that arise and are faced by the supervising judge and observer in carrying out their duties. The study was conducted in Kendari City, precisely at the Class IIa Kendari Penitentiary Office. This study uses descriptive research because the data obtained in the field are presented descriptively using the empirical normative approach method. Based on the analysis of the data and facts that the author has obtained, the author concludes, among others: a) The supervisory task requires a lot of time and energy. In addition to serving as a Supervising Judge and Observer at the Kendari District Court, he must also continue to carry out his duties as a judge who also examines and decides cases at the Kendari District Court. In carrying out the duties of the Supervising Judge and Observer towards prisoners in the Class II A Kendari Penitentiary, he still experiences obstacles because there are limited manpower by the Judge to carry out his duties, although the Supervising Judge and Observer are appointed by the Chief Judge of the Kendari District Court.; b) For the obstacles faced by the Supervising Judge and Observer in carrying out their duties such as the lack of facilities and infrastructure, in carrying out their duties. The Supervising and Observing Judges encountered several problematic factors that became obstacles. The obstacles faced were that there was still the implementation of supervision duties on prisoners who had been released or on convicts who were sentenced to conditional sentences. The implementation of supervision to the Class II A Kendari Penitentiary could not be carried out continuously due to the busyness and main duties of a judge in examining criminal cases submitted to the Supervising and Observing Judge, as well as the large number of prisoners who had to be handled by one Supervising and Observing Judge, so that supervision and observation were less effective. As well as the problem of funds, facilities and infrastructure related to the special room used in the Penitentiary including the budget to ensure the implementation of supervision and observation duties.
