PROSES PENYELIDIKAN DAN PENYIDIKAN TERHADAP PELAKU TINDAK PIDANA MINUMAN KERAS DI KOTA KENDARI (Suatu Studi di Reskrimum Polda Sultra)
Abstract
The research aims (1) to find out the obstacles experienced by the Southeast Sulawesi Regional Police Criminal Investigation Unit in carrying out investigations against perpetrators of alcoholic beverage crimes. (2) to find out the efforts made by the Southeast Sulawesi Regional Police Criminal Investigation Unit to overcome obstacles in carrying out investigations against perpetrators of alcoholic beverage crimes. The research location to obtain the data needed to assist in writing this law is: at the Southeast Sulawesi Regional Police Criminal Investigation Unit located on Jalan , the location was chosen because there have been cases of perpetrators of alcoholic beverage crimes resulting in other crimes. The implementation of the research, the author will carry out. Research Results (1) Law enforcement efforts applied by Criminal Law, namely Investigation. Investigation is a series of actions carried out by collecting evidence of police efforts in investigating cases of illegal liquor sales, conducting checks on stalls, markets, and shops that sell alcoholic beverages of class A, B, and C that do not meet existing requirements and people who sell liquor openly and without a business permit. Further efforts made by the police to supervise and control alcoholic beverages include conducting surprise operations with more intensive time. After conducting a joint raid and finding illegal liquor, investigators confiscate evidence of liquor obtained during the raid or operation to then be recorded and laboratory examined to determine the content of the liquor and then destroyed witnessed by authorized officers. Conducting guarding and monitoring of places that are considered vulnerable, as well as fostering facilities and infrastructure. The police also provide direction, counseling or socialization to the general public, especially teenagers, regarding the negative impacts caused by these alcoholic beverages. (2) The obstacles faced by the police in investigating cases of illegal liquor sales are the frequent failure of raids due to leaks of information about control operations or raids to be carried out by the police, or resistance in carrying out raids to control liquor in Southeast Sulawesi.
