Abstract

The research aims (1) to find out the mechanism for resolving criminal cases of theft committed by children in the Police (2) to find out the obstacles faced by the PPA Unit of the Southeast Sulawesi Regional Police in implementing criminal sanctions for criminal theft committed by children. In carrying out the research process, the author will carry out the research at the PPA of the Southeast Sulawesi Regional Police because the initial investigation process carried out by the investigator is guided by Law No. 35 of 2014 concerning Child Protection. The results of the research and discussion regarding the resolution of criminal cases of theft committed by children in the Process at the Southeast Sulawesi Regional Police are as follows: (1). The mechanism for resolving criminal cases of theft committed by children in the Southeast Sulawesi Regional Police is basically carried out based on the provisions of the Criminal Code and the provisions of formal criminal law regulated in Law No. 35 of 2014 concerning Child Protection. Therefore, the mechanism for resolving criminal cases of theft committed by children is in the form of stages of case examination processed by the police, (2). Obstacles faced in implementing criminal sanctions for theft crimes committed by children in the Police are mainly in the form of convoluted statements from suspects. Evidence in resolving criminal cases can be in the form of goods or objects used by the defendant in committing the crime or goods that are the result of the crime committed by the defendant. Evidence is not an element of proof in the law (Article 184 paragraph 1 of the Criminal Code), but its nature can support strengthening the existing evidence.
