TINJAUAN TERJADINYA TINDAK PIDANA PENJUALAN MAKANAN YANG MENGANDUNG BAHAN BERBAHAYA (Suatu Studi di Polda Sultra)
Abstract
Food is a basic necessity for humans. Sadly, currently many foods are found to contain hazardous materials according to Food Law Number 18 of 2012. Crimes in the food sector are very disturbing to the public because their impacts can not only endanger human health but also human safety both in the short and long term. The problems studied by the author are what factors cause the occurrence of criminal acts of selling food containing hazardous materials in Kendari City and what are the efforts to overcome the occurrence of criminal acts of selling food containing hazardous materials in Kendari City. The approach to the problem in this study uses a normative legal approach and empirical legal approach. The data used are primary data and secondary materials. The data collection method in this study uses library research and field research. Data analysis uses qualitative data analysis. The results of the study and discussion show that the factors causing producers to sell hazardous food are because the level of knowledge about food safety is relatively low. Consumers of this food generally come from the lower middle class. The level of consumer knowledge about food safety is also relatively low. Efforts to overcome this are carried out by empowering the community as the primary target of health promotion. Socialization through counseling, community empowerment efforts in terms of facilities and infrastructure can also be done, namely by providing facilities that can be used by the community to report cases of food using hazardous materials. The suggestion in this thesis is that the Government coordinates with related agencies including BPOM, YLKI, and the Health Service so that food producers do not add hazardous substances to food. The community must also be smarter in buying food that is safe for consumption.
