TINJAUAN YURIDIS TERHADAP PENGGUNA KARTU KREDIT DI BANK DANAMON CABANG BAUBAU
Abstract
This study aims: 1) To find out and understand the legal protection for credit card users issued by Bank Danamon if their credit card is lost. 2) To find out and understand the responsibility of Bank Danamon (issuer) to card holders and Merchants in conducting buying and selling transactions. The author uses descriptive qualitative analysis. Qualitative descriptive is the selection of appropriate data so that the reality in the field can be clearly explained and can avoid the use of inappropriate data. The results of this study indicate that: 1) the protection provided by the Bank issuer to credit card users if the credit card is lost, the credit card holder must immediately report to the Bank issuer either directly or by telephone so that the bank as the credit card issuer can immediately block the credit card that has been declared lost. If the credit card user does not report the loss of the credit card, the Bank issuer cannot provide legal protection from the credit card that has been issued so that the credit card user does not get legal protection from the bank because the error is not on the bank but the error is in the hands of the credit card user itself. 2) Bank Danamon's responsibility to card holders and merchants in conducting sales transactions is to provide services and provide guarantees in the sales process as the function of the credit card issuer who is responsible for credit card billing and has the right to block the use of credit cards if the user or customer is late in paying their bills, so that credit card users are also responsible for all transactions including bills, fees and interest charged to their accounts. Buyers are also responsible for paying the price to merchants in the form of services that have been purchased through credit cards, while merchants or sellers appointed by the bank are responsible for the approval of sales drafts, because the sales drafts function as proof of transactions that will be submitted to the buyer as the cardholder.
