TINJAUAN HUKUM TERHADAP PENGUPAHAN PEKERJA (Suatu Studi di Toko Ramai Kendari)
Abstract
This study aims: 1) To find out and understand whether the wages of workers at the Ramai Kendari store are in accordance with the provisions of Law Number 13 of 2003. 2) To find out and understand the efforts made by the owner of the Ramai Kendari store so that protection for workers can be implemented. This study was conducted in Kendari City, specifically at the Ramai store and the Social, Manpower and Transmigration Service of Kendari City. Data processing uses a qualitative descriptive method, meaning that the data obtained based on reality is then linked to the implementation of applicable laws and regulations, discussed, analyzed, and conclusions are drawn which are finally used to answer existing problems. The results of this study indicate that: 1) The implementation of wages for workers at the Ramai Kendari store is not in accordance with that stipulated in the Manpower Law because the wages received by workers/employees each month are still less than the Provincial or Regency/City Minimum Wage that has been determined. 2) Efforts made by the owner/leader of the Ramai store so that protection for workers can be implemented are by implementing an occupational health and safety management system to reduce the risk of work accidents in order to increase worker productivity. These efforts have not been maximized because the owner/manager of the Ramai Kendari store did not include his workers/employees in the social security program for workers as stipulated in the Employment Law.
