FAKTOR PENGHAMBAT DALAM PELAKSANAAN CUTI BERSYARAT (CB) (Suatu Studi di Rutan Klas IIA Kendari)
Abstract
The purpose of this study aims to determine: 1). Inhibiting factors in the implementation of Conditional Leave (CB) for prisoners in Class II/A Kendari Penitentiary. 2). Efforts to overcome obstacles in the implementation of Conditional Leave (CB) for prisoners in Class II/A Kendari Penitentiary. This study was conducted in Kendari City, namely in Class II/A Kendari Penitentiary, using the type of research, namely empirical normative. The data collection methods used were document studies, field surveys and interviews using qualitative descriptive analysis. Based on the results of the study, it can be seen: 1). Inhibiting factors in the implementation of conditional leave (CB) for prisoners in Class IIA Kendari Penitentiary are: a. Internal factors consist of: 1. Violation of the Rules of Procedure, for example if the prisoner who is temporarily given a CB commits a violation, namely abusing other prisoners or trying to escape; and. 2. Length of the Process of Files for Granting Conditional Leave (CB). b. External factors consisting of: 1. The community is restless and afraid of the presence of prisoners who receive conditional leave (CB) in their environment (society). 2. Committing a new violation or crime so that his/her Conditional Leave (CB) rights will be revoked and processed with a new crime. 3. No guarantor for the prisoner. 2) Efforts to overcome obstacles in the implementation of conditional leave (CB) for prisoners at the Class II/A Kendari Prison, namely: a. Improving Human Resources (HR) for employees, employee welfare, and religious guidance. b. Religious guidance for prisoners such as; short boarding schools for inmates. c. Holding socialization or legal counseling to the community about the implementation of Conditional Leave (CB) so that it can change the negative public view of prisoners who are undergoing Conditional Leave (CB).
