PENYELESAIAN SENGKETA PERSELISIHAN HUBUNGAN INDUSTRIAL DITINJAU DARI UNDANG – UNDANG NO. 2 TAHUN 2004 (Studi di Pengadilan Hubungan Industrial di Kota Kendari)

Abstract

The purpose of this study is to find out and understand the Settlement of Industrial Relations Disputes and to find out and understand the efforts made by the related parties in the Settlement of Industrial Relations Disputes. To achieve the objectives of the study, the research method used is to analyze qualitative data qualitatively processed and analyzed normatively empirically by taking an approach to the problems in this writing. The results of the study show that Law No. 2 of 2004 concerning PPHI has carried out institutional reform and mechanism reform in resolving labor disputes which are marked by the choice of settlement methods, the establishment of PHI, the elimination of the appeal institution, and time limits in handling cases. This is to further ensure the creation of a sense of justice for the parties to the case, according to Law No. 2/2004, dispute resolution is prioritized through negotiations to seek consensus outside the court. Industrial Relations Court (PHI). One thing that is very encouraging for the development of our labor law is the inclusion of PHI as a special court under the district court in the hierarchical structure of the general judicial environment.
