FAKTOR PENYEBAB TERJADINYA TINDAK PIDANA PENYALAHGUNAAN SENJATA API (Suatu Studi Kasus Pada Kepolisian Daerah Sulawesi Tenggara)

Abstract

This study aims to determine the factors causing the occurrence of firearms abuse by police officers in the jurisdiction of the Southeast Sulawesi Regional Police, as well as to determine the mitigation efforts that can be carried out by the police in an effort to prevent and overcome acts of firearms abuse by police officers in the jurisdiction of the Southeast Sulawesi Regional Police. This study took the research location at the Southeast Sulawesi Regional Police office, which of course is related to the data sources collected in the form of primary data and secondary data. Data collection was carried out using interview techniques and also secondary analysis. From the results of the study, it was concluded that the acts of firearms abuse that occurred in the Kendari area, mostly occurred because of the psychological and mental conditions of police officers who were still unstable. The cause of the use of firearms by police officers is because of the unstable emotions of an officer due to his immaturity and because of the lack of discipline of the police officer in storing and securing his firearms. Efforts to overcome acts of firearms abuse in the Kendari area are in the form of preventive and repressive actions. Preventive measures include tightening psychological tests and mental tests for the right to hold firearms, not allowing members with personal, family or official problems to borrow firearms and immediately withdrawing firearms in the hands of members who show changes in behavior, are having problems or who have committed disciplinary violations. Repressive efforts include conducting examinations of police officers holding firearms, checking the procedures for issuing firearms permits by police officers, following up on public reports regarding misuse of firearms by police officers. Repressive efforts against misuse of firearms include imposing sanctions, both disciplinary sanctions, professional code of ethics sanctions, and criminal sanctions.
