PROSES PENYELESAIAN PERCERAIAN KARENA FAKTOR KEKERASAN DALAM RUMAH TANGGA (Suatu Studi Pada PengadiIan agama Andoolo)
Abstract
This study aims to determine whether domestic violence can be used as a reason to file for divorce. To determine the legal consequences arising from divorce caused by domestic violence in the Andoolo Religious Court. This study was conducted at the Andoolo Religious Court, South Konawe Regency, Southeast Sulawesi Province on the grounds that it was in that place to facilitate obtaining the data needed by researchers in completing the data for compiling the completion of the thesis as a final assignment in taking courses at the Faculty of Law, University of Southeast Sulawesi. With data collection techniques in a study is a very important thing in writing a study. This data collection technique will be needed to be analyzed further as expected. In relation to this, the author obtained primary data through direct interviews with parties related to the study, as well as secondary data which is supporting data or supporting information for the completeness of primary data. The results of this study indicate that the factors that cause divorce in Konsel Regency are due to quarrels, disputes or domestic violence, no responsibility, economy, and distant residences. This is more dominant because the economic potential in Konsel is very limited so that the people of Konsel leave the city to look for a more decent income and they do not think about the impact that will occur on harmony in the household, for families who cannot cope, the household will be disharmonious and end in divorce. The causes of divorce are inseparable from socio-economic factors, domestic violence, third parties and early marriage. As for cases of suicide in Konsel, the motives are depression, economic demands and marriages that are not approved by parents. Meanwhile, the incident of underage marriage (19 years) according to data from the Konsel Ministry of Religion, 46 couples were registered as married in 2020 or a significant increase compared to 2019 which was only 11 events. Meanwhile, the cause of early marriage is due to the low level of education between the two partners.
