PENEGAKAN HUKUM DALAM PENYELESAIAN KEJAHATAN PENCURIAN KENDARAAN BERMOTOR (Suatu Studi di Polresta Kendari)

Abstract

This study aims to analyze the law enforcement mechanism carried out by the Kendari Police in resolving motorcycle theft cases, to identify the obstacles faced by the police in handling the case. This study was conducted at the Kendari Police. The data that was successfully obtained or that had been successfully collected during the study, both primary and secondary data, were then analyzed qualitatively and then presented descriptively, namely describing, describing and explaining in order to obtain a picture that can be understood clearly and directed to answer the problems to be studied. The results of the study indicate that (1) The factors causing motor vehicle theft in Kendari City are economic factors, the environment, and the lack of deterrent effects of imposing sanctions. These factors interact with each other and influence each other. (2) The efforts made by the Kendari Police in minimizing the occurrence of motor vehicle theft in Kendari City are preventive efforts and repressive efforts. Preventive efforts are one way to prevent crime, such as appeals and conducting patrols. Meanwhile, repressive efforts are to prosecute perpetrators of crimes according to their actions and to correct them so that they realize that the actions they have committed are actions that violate the law and are detrimental to society, these actions include arrest, detention and the process of referring cases to court.
