TINJAUAN YURIDIS TERHADAP TINDAK PIDANA UJARAN KEBENCIAN MELALUI MEDIA SOSIAL

Abstract

This study aims to determine and analyze the handling of hate speech cases through social media when reviewed legally, as well as to determine and analyze the inhibiting factors in handling hate speech cases through social media. Which technological developments on the one hand make it easier for people to carry out activities to meet their needs and interact with other people wherever they are. Technology also brings benefits such as making it easier for people to carry out daily activities. However, on the other hand, technological developments are also one of the factors that can cause crime. The forms of crime that exist today are increasingly varied. While the impact of hate speech on minor to serious human rights violations. Always initially just words, either on social media, or through leaflets, but the effect is able to move the masses to trigger conflict and bloodshed. If not handled effectively and efficiently and in accordance with the provisions of laws and regulations, it has the potential to give rise to widespread social conflict, and has the potential to cause discrimination, violence and/or loss of life. This study uses a normative legal research method, namely examining laws and legal theories related to criminal acts, hate speech through social media based on positive Indonesian law. The problem approach used is the statutory approach and the case approach.
