FAKTOR PENYEBAB TERJADINYA TINDAK PIDANA PENADAHAN HASIL PENCURIAN (Suatu Studi di Polres Kendari)

Abstract

The objectives of the study were: 1). To determine the factors causing the occurrence of criminal acts of receiving stolen proceeds. 2). To determine efforts to overcome the occurrence of criminal acts of receiving stolen proceeds. This study was conducted in Kendari City, precisely at the Kendari Police, using the type of research, namely empirical normative. The data collection methods used were document studies, field surveys and interviews using qualitative descriptive analysis. Based on the results of the study, it can be seen: 1. The factors causing the occurrence of criminal acts of receiving stolen proceeds are because they want to follow the lifestyle (trend) of today's young people, want to have something, emotional impulses, behavior, and low levels of education and lack of legal awareness in society. The level of education that a person has is one of the factors that influences the occurrence of crime, this is based on the consideration that the higher the education they have, the broader their horizons and tend to act rationally rather than irrationally. Conversely, the lower the level of education, the greater the opportunity to commit irrational acts to do evil. 2. Efforts to prevent the occurrence of criminal acts of receiving stolen proceeds, namely preventive measures are the most appropriate way, because preventive efforts are more effective in the way of handling with the mission to avoid criminal acts/violations. Efforts made are in the form of legal counseling, both directly and indirectly, to the community. Repressive efforts against criminal acts of receiving stolen proceeds must be carried out with firm action in accordance with the Criminal Code without looking at who the perpetrator of the crime is, these efforts are carried out by competent law enforcers such as the Police, Prosecutors and Judges through the case process against a criminal act, but in the efforts to take action, there is an aspect of coaching the suspect/convict without sacrificing the essence of the application of sanctions according to applicable regulations.
